These Terms of Service ("Terms") govern your use of mfa-advisory.com (the "Site"), operated by Merchant Financial Advisory LLC ("MFA," "we," "us"). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
1. Informational purposes only
The Site, including our blog ("MFA Insights"), graphics, checklists and newsletters, provides general information only. It is not tax, accounting, legal, investment or financial advice, and it is not a substitute for advice tailored to your circumstances. See our Disclaimer for details.
2. No client relationship
Using the Site, sending us a message, or booking or attending a free consultation does not create a client or professional relationship with MFA. A client relationship begins only when both parties sign a written engagement letter. Until then, please don't send confidential or time-sensitive information, and don't rely on us to meet any filing deadline for you.
3. Accuracy and timeliness
We work to keep content accurate and to cite official sources. However, tax laws, IRS guidance, software features (including QuickBooks) and deadlines change often, and content reflects the date it was written. We don't guarantee that the Site is complete, current or error-free, and we have no obligation to update past content.
4. Acceptable use
You agree not to misuse the Site. This includes attempting to disrupt or gain unauthorized access to it, submitting spam or malicious content through our forms, scraping the Site in bulk, or using it for any unlawful purpose.
5. Intellectual property
The Site's content, design, graphics, logos and the "Merchant Financial Advisory" and "MFA" names are owned by or licensed to MFA and are protected by intellectual-property laws. You may view, download and print content, including our keep-handy graphics, for your personal or internal business use, as long as you keep our attribution. You may share links to our articles freely. Any other copying, republishing or commercial use requires our written permission.
6. Third-party services and links
The Site uses and links to third-party services, such as Google Calendar for booking, Netlify for hosting and forms, and sites like IRS.gov, Upwork, Fiverr, LinkedIn and Instagram. We don't control those services and aren't responsible for their content, availability or practices. Your use of them is governed by their own terms. References to products such as QuickBooks are for information only and don't imply endorsement by or affiliation with their owners.
7. Testimonials and reviews
Client reviews on the Site reflect individual experiences on platforms such as Fiverr and Upwork. They don't guarantee similar results for you.
8. Disclaimer of warranties
The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied. This includes warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
9. Limitation of liability
To the fullest extent permitted by law, MFA and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, penalties, interest or tax benefits, arising from your use of, or reliance on, the Site or its content. Our total liability for any claim relating to the Site will not exceed $100. These limits do not apply to services provided under a signed engagement letter, which governs those services.
10. Indemnity
You agree to indemnify and hold MFA harmless from claims arising out of your misuse of the Site or your violation of these Terms.
11. Governing law
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute relating to the Site will be brought in the state or federal courts located in New Jersey, and you consent to their jurisdiction.
12. Changes
We may update these Terms at any time by posting a revised version on this page. Continuing to use the Site after changes means you accept them.
